Federal Judge Rules Missouri’s Second Amendment Preservation Act Unconstitutional

A federal Judge in Missouri has ruled that a state law, known as the Second Amendment Preservation Act (SAPA), is unconstitutional.

This law aimed to invalidate many federal gun regulations, but U.S. District Judge Brian Wimes for the Western District of Missouri wrote that SAPA violates the supremacy clause of the U.S. Constitution.

This clause holds that federal laws take priority over conflicting state laws. The judge argued that SAPA interferes with the federal government’s ability to enforce lawfully enacted firearms regulations designed to protect citizens.

The ruling is a victory for the U.S. Justice Department, which had sought to invalidate the law. The Justice Department has argued that SAPA harms partnerships between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and state and local law enforcement. The ruling is likely to be appealed.
